Poland is one of the few EU states with two distinct reduced rates. Use the VAT calculator in Custom-rate mode to compute any amount at either rate, or check a Polish VAT number format with the VAT validator.
What Each Reduced Rate Covers
8% Stawka obniżona
- Food — most food products not covered by the 5% rate, including restaurant meals and prepared food.
- Books, newspapers and magazines — printed and digital publications, including e-books and audiobooks.
- Passenger transport — bus, tram, rail tickets within Poland.
- Medical equipment and aids — wheelchairs, hearing aids, prostheses, corrective glasses.
- Cultural events — cinema, theatre, museum admission, live performances.
- Social housing renovation — energy efficiency works on existing social housing.
- Agricultural inputs — animal feed, fertiliser, seeds.
5% Stawka obniżona
- Basic food — bread, milk, cheese, eggs, meat, fresh fruit and vegetables, rice, pasta, flour, sugar, olive oil.

- Medical aids — specific aids not covered under 8%.
If your invoice mixes standard and reduced items, you must split the taxable amount per rate. The invoice generator handles split-rate VAT automatically.
Zwolnienie Podmiotowe — The Small Business Exemption
Poland offers a VAT exemption for small businesses known as the zwolnienie podmiotowe (subject exemption):
- Eligibility: annual turnover below PLN 240,000 (approximately €55,000) in the previous calendar year.
- Effect: you do not charge VAT on invoices, do not file VAT returns (only a simplified annual return), and cannot reclaim input VAT on purchases.
- Invoice impact: your invoices must NOT show a VAT amount. Include the statement: "Zwolnienie z podatku od towarów i usług na podstawie art. 113 ust. 1 ustawy." (Exempt from VAT under Article 113(1) of the VAT Act.)
- Loss of exemption: if turnover exceeds PLN 240,000 in any year, you become a regular VAT payer from the first day of the month following the excess.
- Voluntary registration: you can voluntarily register for VAT even below the threshold if reclaiming input VAT is beneficial.
Calculate your gross quote regardless of scheme with the VAT calculator — use 0% in Custom mode if you are zwolnienie podmiotowe.
VAT Registration in Poland
- Who must register: any business exceeding the PLN 240,000 threshold, plus all non-Polish businesses making taxable supplies in Poland.
- Where: register via the Urząd Skarbowy (Tax Office) using form VAT-R.
- What you receive: a NIP number (Numer Identyfikacji Podatkowej, format: 10 digits) and a VAT registration confirmation.
- Non-EU businesses: must appoint a fiscal representative (przedstawiciel podatkowy) in Poland before registering for VAT.
- Timeline: register within 30 days of commencing taxable activity or exceeding the threshold. Late registration triggers retroactive VAT assessments and penalties.
Polish Invoice Requirements
Under the Polish VAT Act (Ustawa o podatku od towarów i usług, Article 106) and the EU VAT Directive (Articles 226–231), every VAT invoice issued by a Polish business must contain:
- Supplier details — full legal name, registered address, NIP number.
- Customer details — full name and address; for cross-border B2B their NIP/VAT ID as well.
- Invoice number — unique, sequential, no gaps allowed in the numbering series.
- Invoice date — the date of issue; add date of supply if it differs.
- Description — nature and quantity of goods or services supplied.
- Unit price — net price per unit, excluding VAT.
- Rate and amount — applicable VAT rate (23%, 8% or 5%) per line, net subtotal per rate, total VAT amount, gross total.
- Special references — reverse charge statement where applicable, exemption references, zwolnienie notice if exempt.

JPK_V7 — Poland's Structured VAT Return
Poland is one of the few EU countries requiring structured audit file submissions for VAT:
- JPK_V7M: monthly filing — due by the 25th of the following month. Contains detailed invoice data (JPK_FA) and VAT return (VAT-7) combined.
- JPK_V7K: quarterly filing — for businesses with turnover below EUR 200,000. Due by the 25th of the month following the quarter.
- Mandatory fields: every invoice must include a NPWZ (Numer KSeF) — a unique invoice identifier from the Krajowy System e-Faktur (KSeF) platform for B2B invoices.
- KSeF: Poland's mandatory e-invoicing platform (Krajowy System e-Faktur) became mandatory for all businesses from 1 February 2026. All B2B invoices must be issued and received through KSeF.
For cross-border invoices, use the UBL e-invoice kit to create standards-based UBL XML files.
Reverse Charge in Poland
The reverse charge mechanism shifts VAT accounting from seller to buyer in these Polish scenarios:
- B2B services from Poland to an EU customer: you invoice at 0 PLN VAT with a reference like: "Odwrócony obowiązek podatkowy — Art. 196 Dyrektywy 2006/112/WE." Both your NIP and the customer's must appear on the invoice.
- B2B services received from abroad: if a non-Polish supplier provides services to your Polish business, you self-account Polish VAT under the reverse charge and report it on your JPK_V7 return.
- Domestic construction: the main contractor self-accounts VAT on payments to subcontractors in the construction sector.
- Specific supplies: sales of scrap metal, mobile phones, computers, electronics, certain electronics, gaming consoles — the buyer self-accounts VAT regardless of location.
Check any cross-border scenario with the reverse-charge vs OSS checker before invoicing.
OSS — Poland and the One Stop Shop
Poland participates in the EU One Stop Shop (OSS) since 1 July 2021. What this means for Polish sellers:
- B2C distance sales of goods to other EU countries — once your pan-EU cross-border turnover passes €10,000 per year (about PLN 43,000), you must charge the destination country's VAT rate and declare it through OSS.
- Registration: register for OSS via the Urząd Skarbowy portal. You file one quarterly OSS return covering all destination countries, and Poland distributes the collected VAT to each member state.
- Below €10,000: you may charge Polish 23% VAT on all B2C cross-border sales (domestic simplification).
- B2B: OSS does not apply to B2B — reverse charge governs those transactions.
Run any scenario through the reverse-charge vs OSS checker to confirm the correct treatment.
Worked Examples
Warsaw consultant — standard rate invoice
A consultant invoices a Polish client PLN 15,000 net for advisory work. Standard 23% VAT applies. Gross: PLN 15,000 × 1.23 = PLN 18,450 (VAT: PLN 3,450). Use the VAT calculator Add mode to verify.
Polish restaurant — split rate invoice
A Kraków restaurant invoices PLN 8,000 net for food consumed on premises (8% rate) and PLN 2,000 net for bread sold for takeaway (5% rate). VAT on food: PLN 640. VAT on bread: PLN 100. Total VAT: PLN 740. Total including VAT: PLN 10,740.
B2B services to a German company
A Wrocław design agency provides branding to a client in Berlin with a valid DE VAT ID. Reverse charge applies: invoice at 0 PLN VAT, show both NIP numbers, add reverse charge reference. The German client self-accounts 19% on their side.
Worked Example — Adding 5% Reduced VAT
A Gdańsk bakery sells bread worth PLN 1,000 net. The reduced 5% rate applies to basic food.
