How to Register for VAT in Germany (2026 Complete Guide)

Everything you need to know about German VAT (Umsatzsteuer/MwSt) registration: Kleinunternehmerregelung (€25,000 previous year / €100,000 current year), Finanzamt process, Fragebogen zur steuerlichen Erfassung, Steuernummer vs USt-IdNr, and cross-border OSS rules. Updated for 2026.

Quick Answer: Do You Need to Register for German VAT?

You must register for German VAT if:

  • Your annual turnover exceeds €25,000 in the previous calendar year — or is expected to exceed €100,000 in the current year (Kleinunternehmer thresholds since 2025)
  • You're a non-German business making taxable supplies in Germany
  • You're an EU business exceeding the €10,000 pan-EU distance-selling threshold (B2C goods)
  • You provide digital services to German consumers (no threshold — OSS required)
  • You receive services from abroad subject to reverse charge (§13b UStG)

If you stay under €25,000 in the previous year (and expect under €100,000 this year), you can use the Kleinunternehmerregelung (§19 UStG) — but you can't reclaim input VAT and can't issue VAT invoices.

Kleinunternehmerregelung (§19 UStG) — The Small Business Exemption

Germany's unique small business exemption is both a blessing and a strategic decision point. Here's the reality:

How It Works (2026 Rules)

CriterionThresholdConsequence
Previous year turnover≤ €25,000 (previous year; €100,000 current-year ceiling)Eligible for Kleinunternehmer
Current year expected turnover≤ €100,000Must not exceed (prognosis)
If exceeded mid-year€100,001+Standard VAT applies — confirm the switch date with your Finanzamt
If exceeded previous year€25,001+Standard VAT from January 1 of current year

What Kleinunternehmer Means in Practice

✅ Advantages

  • No VAT on invoices (simpler pricing for B2C)
  • No monthly/quarterly VAT returns (UStVA)
  • No advance VAT payments (Vorauszahlungen)
  • Simpler accounting — just track revenue

❌ Disadvantages

  • Cannot reclaim input VAT — 19% on all business expenses lost
  • Cannot show VAT on invoices — B2B clients can't deduct
  • Must add: "Gemäß §19 UStG wird keine Umsatzsteuer berechnet"
  • Threshold monitoring required monthly
  • Perceived as "small" by corporate clients

The Input VAT Trap — Run Your Numbers

A freelancer with €20,000 revenue and €8,000 business expenses (laptop, software, coworking, travel):

  • As Kleinunternehmer: Net income = €20,000 - €8,000 = €12,000 (no VAT reclaim)
  • Standard VAT (opt-in): Revenue €20,000 + €3,800 VAT = €23,800 invoiced. Input VAT €1,520 reclaimed. Net VAT payable = €2,280. Net income = €20,000 - €8,000 + €1,520 - €2,280 = €11,240

Wait — Kleinunternehmer wins here? Only because expenses are low. Flip it: €20,000 revenue, €15,000 expenses (heavy equipment year):

  • Kleinunternehmer: €5,000 net
  • Standard VAT: Input VAT €2,850 reclaimed. Net income = €20,000 - €15,000 + €2,850 - €950 = €6,900

Rule of thumb: If business expenses > ~30% of revenue, standard VAT usually wins. Use our VAT calculator to model both scenarios.

When You MUST Exit Kleinunternehmer

  1. Previous year turnover > €25,000 (or current year expected > €100,000) → mandatory from Jan 1
  2. Current year turnover expected to pass €100,000 → standard VAT; confirm the switch date with your Finanzamt
  3. You voluntarily opt for standard VAT (binds for 5 years per §19 Abs. 2 UStG)
  4. You make intra-community acquisitions > €10,000/year

Two VAT Numbers: Steuernummer vs USt-IdNr

Germany issues two separate VAT identifiers — confusion here causes compliance failures.

IdentifierGerman NameFormatPurposeIssued ByTimeline
SteuernummerTax NumberDE + 13 digits (varies by Bundesland)
e.g., 12/345/67890 or DE123456789012
Domestic VAT returns (UStVA), invoices to German customers, correspondence with FinanzamtLocal Finanzamt1-3 weeks after registration
USt-IdNrVAT ID (Umsatzsteuer-Identifikationsnummer)DE + 9 digits
e.g., DE123456789
Cross-border B2B invoices (reverse charge), VIES validation, OSS registration, EC Sales ListBundeszentralamt für Steuern (BZSt)2-6 weeks after Steuernummer

Which One Goes on Your Invoice?

Domestic B2B/B2C Invoice

Steuernummer only. Format: "Steuernummer: 12/345/67890"

Cross-Border B2B Invoice (Reverse Charge)

Both your USt-IdNr and client's VAT number. Format: "USt-IdNr: DE123456789" + "Client VAT: FR12345678901"

OSS Return / VIES Check

USt-IdNr only. Steuernummer not accepted.

Critical: Never use Steuernummer for cross-border B2B. Your client's VIES check will fail. Never use USt-IdNr for domestic invoices — Finanzamt expects Steuernummer.

Step-by-Step: Registering for German VAT (2026 Process)

Step 1: Determine Your Finanzamt

Germany has ~600 local Finanzämter. Jurisdiction is based on:

  • Resident: Your private address (Wohnsitz)
  • Non-resident: Business location or — if none — Finanzamt Neubrandenburg (central for foreign entrepreneurs)

Find yours: BZSt Finanzamt Search

Step 2: Prepare Documents

  1. Identity: Passport/ID + Meldebescheinigung (registration certificate) if resident
  2. Business proof: Gewerbeanmeldung (trade registration from Gewerbeamt) OR Freiberufler confirmation (from Finanzamt — no Gewerbeamt needed)
  3. Address proof: Mietvertrag or Eigentumsnachweis for business premises
  4. Bank details: German IBAN for VAT refunds (SEPA)
  5. Turnover estimate: Monthly projection for first 12 months (determines filing frequency)
  6. Cross-border plans: List EU countries for USt-IdNr application

Step 3: Submit Fragebogen zur steuerlichen Erfassung

This is the official tax registration questionnaire. Two channels:

Option A: ELSTER (Online — Recommended)

  1. Register at elster.de (requires German tax ID or video ident via PostIdent)
  2. Navigate: "Formulare" → "Fragebogen zur steuerlichen Erfassung" → "Neuaufnahme"
  3. Select: "Unternehmer" → "Umsatzsteuer"
  4. Complete all sections (see critical fields below)
  5. Submit electronically — immediate confirmation

Option B: Paper Form (Slower — 4-6 weeks)

Download from Bundesfinanzministerium, fill manually, mail to your Finanzamt.

Critical Fields in the Fragebogen

Field (Zeile)What to EnterCommon Mistake
101: SteuerpflichtigerFull legal name (match Gewerbeanmeldung)Brand name instead of legal name
105: RechtsformEinzelunternehmen / GbR / GmbH / Freiberufler / KGFreiberufler ≠ Gewerbe — check with IHK
120: Beginn der TätigkeitActual start date (not future)Post-dating triggers backdated VAT
130: Voraussichtlicher UmsatzHonest 12-month estimate (net)Understating → monthly filing instead of quarterly
140: Kleinunternehmer (§19 UStG)"Ja" ONLY if ≤ €25k previous year (and ≤ €100k current year)Checking "Ja" then exceeding = penalties + backdated VAT
150: USt-IdNr beantragen"Ja" if ANY cross-border B2B plannedForgetting this = no VIES validation possible
160: Innergemeinschaftlicher Erwerb"Ja" if buying goods from EU > €10k/yrMissing = compliance gap
170: OSS/IOSS"Ja" if B2C cross-border > €10kMissing = separate VAT regs in each country
180: Vorsteuerabzug"Ja" if opting for standard VATNot ticking when you want input VAT reclaim

Step 4: Receive Your Identifiers

  • 1-3 weeks: Steuernummer from Finanzamt (mail + ELSTER postbox)
  • 2-6 weeks: USt-IdNr from BZSt (separate letter)
  • Immediate: You can invoice with "Steuernummer beantragt" noted

Step 5: Verify USt-IdNr on VIES

Once received, check immediately at VIES or our VAT Validator. If not found after 6 weeks, contact BZSt: +49 228 406-1240.

German VAT Rates 2026

Germany has only two rates — simpler than most EU countries:

RatePercentageGerman TermApplication
Standard (Regelsteuer)19%NormalsteuersatzAll goods/services not explicitly reduced
Reduced (Ermäßigter Steuersatz)7%Ermäßigter SteuersatzFood, books, public transport, medical, cultural, hotels, agriculture

What Qualifies for 7% (Common Misclassifications)

  • Food: Groceries = 7%. Restaurant meals/catering = 19%. Takeaway food = 7% (since 2020)
  • Books: Print + e-books + audiobooks = 7%. E-newspapers = 7%. Advertising brochures = 19%
  • Transport: Regional/public transport = 7%. Long-distance (ICE/IC) = 19%. Taxi = 19%
  • Medical: Wheelchairs, hearing aids, glasses = 7%. Cosmetic surgery = 19%
  • Culture: Cinema, theatre, museums = 7%. Streaming subscriptions = 19%
  • Hotels: Overnight + breakfast = 7%. Minibar, laundry, phone = 19%
  • Artists/Authors: Royalties (§24 UStG) = 7%. Agency fees = 19%

Mixed Invoices

If one invoice has 19% and 7% items: split the taxable amount per rate. Our Invoice Generator handles this automatically — select Germany, add lines with different rates.

Cross-Border: Reverse Charge, OSS & Intra-Community

B2B Services to EU VAT-Registered Businesses (Reverse Charge)

Your invoice shows:

  • €0 MwSt
  • Your USt-IdNr (DE123456789)
  • Client's EU VAT number
  • Mandatory text: "Steuerschuldnerschaft des Leistungsempfängers — §13b UStG / Art. 196 RL 2006/112/EG"

File ZM (Zusammenfassende Meldung) monthly/quarterly via ELSTER. Deadline: 25th following month.

B2C Distance Sales of Goods (EU Consumers)

  • Under €10,000/year pan-EU: Charge German 19% MwSt, file UStVA
  • Over €10,000/year: Register for Union OSS at BZSt OSS Portal
  • OSS = one quarterly return (German + all EU), one payment to BZSt

B2C Digital Services

  • Always taxed at consumer's location (no threshold)
  • Non-EU sellers: Non-Union OSS (same BZSt portal)
  • EU sellers: Union OSS

Intra-Community Acquisitions (Buying Goods from EU Suppliers)

  • Over €10,000/year: Self-assess German MwSt (reverse charge)
  • Declare in UStVA: "Innergemeinschaftliche Erwerbe" (box 46/47)
  • Recover same amount as input VAT (neutral if fully taxable)

Special Domestic Reverse Charge (§13b UStG)

Applies even for domestic transactions:

  • Construction services (Bauleistungen)
  • Emission allowances (Emissionsberechtigungen)
  • Gold investment (Investmentgold)
  • Mobile phones, tablets, laptops (to resellers)
  • Gas/electricity certificates

Buyer self-accounts 19% — seller invoices €0 VAT with "Steuerschuldnerschaft des Leistungsempfängers — §13b UStG".

Key 2026 Deadlines

  • Monthly UStVA: 10th of following month (Jan return due Feb 10)
  • Quarterly UStVA: 10th of month following quarter (Q1 due Apr 10)
  • Annual UStVA: July 31 following year (2025 return due Jul 31, 2026)
  • Advance payments: Same dates as filings (10th/25th)
  • ZM (EC Sales List): 25th of following month
  • OSS: End of month following quarter (Apr 30, Jul 31, Oct 31, Jan 31)

All via ELSTER. Late filing = Verspätungszuschlag (min €25/month, max €25,000). Late payment = 1%/month + 0.5%/month interest (Säumniszuschlag).

German Invoice Requirements (Rechnungspflicht §14 UStG)

Every VAT invoice must contain (mandatory per §14 UStG + EU Directive):

  1. Your details: Full legal name, address, Steuernummer
  2. Client details: Name, address; for cross-border B2B: their VAT number
  3. Invoice number: Unique, sequential, no gaps (per year or continuous)
  4. Invoice date: Issue date + service/supply date if different
  5. Description: Nature, quantity, scope of goods/services
  6. Unit price: Net price per unit (HT)
  7. Tax breakdown: Applicable rate per line (19%/7%), net amount per rate, total VAT, gross total
  8. Currency: EUR (or other with conversion rate + date)
  9. Special references: Reverse charge text, Kleinunternehmer notice, tax exemption references

Kleinunternehmer Invoice (Mandatory Text)

"Gemäß §19 UStG wird keine Umsatzsteuer berechnet."

Do not show: VAT amounts, VAT rates, USt-IdNr (you don't have one). Show Steuernummer only.

Reverse Charge Invoice (Cross-Border B2B)

"Steuerschuldnerschaft des Leistungsempfängers — §13b UStG / Art. 196 RL 2006/112/EG"

Show: Your USt-IdNr, Client's VAT number, €0 VAT, net amount only.

Real Example: Berlin Freelancer → GmbH Transition

(Composite case based on actual client work — details changed)

Sarah, a UX designer, started as Freiberufler in Berlin (2024). Year 1: €18,000 revenue. Year 2: €35,000. Year 3: €85,000 + hired subcontractor.

  • 2024: Registered via ELSTER, checked "Kleinunternehmer (Ja)". Steuernummer: 30/123/45678. No USt-IdNr.
  • 2025: Revenue €35,000 > €25,000 → mandatory VAT from Jan 1, 2025. Filed "Option zur Regelbesteuerung" Jan 15. Monthly UStVA from Feb. Received USt-IdNr DE123456789 Mar 2025.
  • 2025 H2: First Dutch client (B2B). Reverse charge invoice: €0 VAT, both USt-IdNrs, ZM filing quarterly.
  • 2026: Revenue €85,000 + subcontractor €15,000. Incorporated GmbH (liability, tax planning). New Steuernummer, new USt-IdNr. Input VAT reclaimed on €40,000 equipment/software.
  • Result: Year 3 input VAT reclaimed: €7,600. Admin: ~4 hrs/month (UStVA + ZM + payroll).

Lesson: The Kleinunternehmer → standard VAT transition at €25k is a pivot point. Plan for it. Voluntary opt-in before threshold can smooth the transition.

Common Mistakes I've Seen (And How to Avoid Them)

  1. Confusing Steuernummer and USt-IdNr on invoices: Domestic = Steuernummer. Cross-border B2B = USt-IdNr (both parties). Mixing them = client can't deduct, Finanzamt rejects.
  2. Not monitoring Kleinunternehmer threshold monthly: €25,000 is previous year. €100,000 is current-year prognosis. Exceed €100k mid-year → standard VAT applies from the switch month — confirm the exact date with your Finanzamt, as transitional mechanics changed with the 2025 reform.
  3. Forgetting ZM (EC Sales List) for reverse charge: Even €0 VAT invoices require ZM. Penalty: €100-€5,000 per missing return.
  4. Using "USt-IdNr" on domestic invoices: Finanzamt expects Steuernummer. USt-IdNr is for cross-border only. Shows amateurism.
  5. Not requesting USt-IdNr at registration: Adding later via BZSt takes 6+ weeks. Tick Zeile 150 "Ja" on Fragebogen if any EU B2B planned.
  6. Wrong VAT rate on mixed invoices: Germany has only 19% and 7%. No 0%, no super-reduced. Split per line. Our Invoice Generator does this.
  7. Ignoring §13b reverse charge on construction/tech resale: Domestic B2B for these categories = buyer self-accounts. Seller invoices €0 VAT. Missing = seller liable for unpaid VAT.
  8. Not keeping records 10 years: German tax law (AO §147) requires 10-year retention. Digital PDFs with timestamp + GoBD compliance are fine.
  9. Underestimating advance payments (Vorauszahlungen): Based on prior year. If revenue drops, file "Herabsetzungsantrag" via ELSTER to reduce. Don't overpay.
  10. Forgetting OSS registration at €10,001: Pan-EU B2C goods. Not per-country — total across EU. Register prospectively at BZSt.

FAQ

How long does German VAT registration take?

ELSTER: Steuernummer 1-3 weeks. USt-IdNr from BZSt: 2-6 weeks after Steuernummer. Paper: 4-8 weeks total.

Can I register before moving to Germany?

Yes — use Finanzamt Neubrandenburg (central for non-residents). Need German address (c/o works) and German IBAN.

What if I exceed €100,000 mid-year as Kleinunternehmer?

VAT liability starts 1st day of following month. You must charge VAT from the switch date and file UStVA for that partial period. Confirm the exact switch date with your Finanzamt — transitional mechanics changed with the 2025 reform.

Do I need a German bank account?

Not for registration, but you need a German IBAN for VAT refunds. Wise/Revolut Business DE IBAN works. Non-EU: may need fiscal representative.

Can I be Kleinunternehmer and still get USt-IdNr?

No. USt-IdNr only issued if you opt for standard VAT (Zeile 150 "Ja" + Zeile 180 "Ja"). Kleinunternehmer don't get USt-IdNr.

What's the 5-year binding period (§19 Abs. 2 UStG)?

If you voluntarily opt for standard VAT (leave Kleinunternehmer), you're bound for 5 calendar years. Can't switch back until period ends.

How does the €10,000 OSS threshold work for Germany?

Pan-EU B2C goods sales (ALL EU countries combined). Once exceeded, register for Union OSS at BZSt. File quarterly. One payment covers all EU.

Are there special rules for Heligoland, Büsingen?

Yes. Heligoland & Büsingen am Hochrhein are outside EU VAT territory. Transactions = export/import. No German VAT. Different customs rules apply.

What's the difference between Freiberufler and Gewerbetreibender for VAT?

VAT treatment is identical. Difference: trade tax (Gewerbesteuer) — Freiberufler exempt, Gewerbetreibender pays. IHK membership mandatory for Gewerbe. VAT registration process same.
