Freelancer VAT Invoicing: Complete EU Compliance Guide (2026)

Freelancers face unique VAT challenges: Kleinunternehmer thresholds, reverse charge for EU clients, digital services rules, marketplace deemed supplier, and invoice compliance. This guide covers every scenario with templates, decision trees, and real examples. Updated September 2026.

๐Ÿ“… Updated: September 2026 โœ๏ธ By: CA Neha Tabassum โฑ๏ธ 13 min read

Quick Decision: Which VAT Regime Are You?

๐Ÿ‡ฉ๐Ÿ‡ช Germany-Based

Kleinunternehmer (ยง19 UStG): โ‰ค โ‚ฌ25k prev year, โ‰ค โ‚ฌ100k current year. No VAT on invoices. No input VAT reclaim.
Standard VAT: > โ‚ฌ25k or voluntary opt-in. 19%/7% VAT, input VAT reclaim, USt-IdNr for cross-border.

๐Ÿ‡ซ๐Ÿ‡ท France-Based

Franchise de TVA: โ‰ค โ‚ฌ37.5k services / โ‰ค โ‚ฌ91.9k goods. No VAT. No input VAT.
Standard VAT: > thresholds or voluntary. 20%/10%/5.5%, input VAT reclaim, TVA intracommunautaire.

๐ŸŒ Other EU

Most EU countries offer a small-business regime, but the details differ: the threshold amount, whether it is measured on the previous or current year, and whether a partial rate reduction applies instead of full exemption. Germany (ยง19 UStG) and France (Franchise en base) work differently from each other, and a few Member States have no general option. Check the specific rule for your country with its tax authority rather than assuming the German or French pattern applies. Country rates lists the standard rates; the threshold itself is a national matter.

๐ŸŒ Non-EU Freelancer

Selling to EU clients: Reverse charge (B2B services) โ€” client self-accounts. No EU VAT registration needed. Selling digital services to EU consumers: Non-Union OSS required.

Regime Decision Tree

  1. Where are you established? โ†’ Determines domestic rules
  2. What's your annual revenue? โ†’ Below threshold? โ†’ Kleinunternehmer/Franchise option
  3. Who are your clients? โ†’ B2B EU? โ†’ Reverse charge. B2C EU? โ†’ OSS if > โ‚ฌ10k. Domestic? โ†’ Domestic VAT.
  4. What do you sell? โ†’ Services? โ†’ Reverse charge (B2B). Digital? โ†’ OSS (B2C). Goods? โ†’ Distance selling.
  5. Any high expenses? โ†’ Input VAT reclaim may justify voluntary standard VAT

๐Ÿ’ก Pro Tip: Voluntary Standard VAT Often Pays Off

If your business expenses > 30% of revenue OR you have B2B clients who need VAT invoices OR you buy equipment/software: voluntary standard VAT usually saves money despite the admin. See Kleinunternehmer Decision Guide for calculator.

Common Freelancer Scenarios

1. German Freelancer โ†’ French Corporate Client (B2B Service)

  • Rule: Reverse charge (Art. 196)
  • Invoice: โ‚ฌ0 VAT, both USt-IdNr/TVA intra, reverse charge text
  • Your filing: ZM (EC Sales List) quarterly via ELSTER
  • Client: Self-accounts French 20% VAT

2. French Freelancer โ†’ German Corporate Client (B2B Service)

  • Rule: Reverse charge (Art. 196)
  • Invoice: โ‚ฌ0 VAT, both TVA intra/USt-IdNr, "Auto-liquidation Art. 196"
  • Your filing: DES monthly via impots.gouv.fr
  • Client: Self-accounts German 19% VAT

3. Freelancer (Any EU) โ†’ US Client (B2B Service)

  • Rule: Place of supply = client's location (US) โ†’ outside EU VAT scope
  • Invoice: โ‚ฌ0 VAT, "Outside EU VAT scope โ€” Art. 44 Dir 2006/112/EC"
  • No VIES check needed (US not in VIES)
  • No EC Sales List entry

4. Freelancer โ†’ EU Consumer (B2C Service)

  • Digital (course, SaaS, download): OSS from โ‚ฌ1. Charge consumer's country VAT.
  • Non-digital (consulting, coaching via Zoom): Your domestic VAT (place of supply = your establishment)
  • Platform (Udemy, Fiverr, Upwork): Platform may be deemed supplier โ†’ they handle VAT

5. Freelancer Selling via Marketplace (Upwork, Fiverr, Toptal, Malt)

PlatformDeemed Supplier?Who Charges VAT?Your Invoice
UpworkYES (facilitates payment/delivery)Upwork charges client, remits VATInvoice Upwork (not end client) โ€” โ‚ฌ0 VAT if reverse charge
FiverrYESFiverr charges client, remits VATInvoice Fiverr โ€” โ‚ฌ0 VAT
ToptalYESToptal charges clientInvoice Toptal โ€” โ‚ฌ0 VAT
Malt (EU)YESMalt charges clientInvoice Malt โ€” โ‚ฌ0 VAT

Key: If platform = deemed supplier, you DON'T count this revenue in your โ‚ฌ10k OSS threshold or domestic VAT threshold. You invoice the platform.

Accounting for Platform Income

Net vs Gross Reporting

Example: Upwork Project $5,000

Upwork charges client: $5,000 + VAT (if applicable) = $5,500
Upwork fee: 10% = $500
You receive: $4,500

Your accounting:

  • Revenue: $5,000 (gross billed to client)
  • Platform fee: $500 (business expense)
  • Net income: $4,500
  • VAT: โ‚ฌ0 (reverse charge to Upwork)

Invoice the Platform, Not the Client

  • Your invoice: "Upwork Inc." / "Fiverr International Ltd."
  • Platform's VAT ID (e.g., Upwork: IE3289743SH)
  • Reverse charge text
  • Amount = gross client billing (before platform fee)

Freelancer Expenses: What's VAT-Deductible (Standard VAT Only)

Reverse Charge on B2B Services You Buy

If you buy services from EU vendors (e.g., French designer, Irish SaaS):

  • They invoice โ‚ฌ0 VAT + reverse charge text
  • You self-account 19% German VAT (output)
  • You deduct 19% as input VAT (same return) = net โ‚ฌ0 if fully taxable
  • Report in ZM (EC Sales List) + UStVA

FAQ

Do I need a VAT number to start freelancing?

Germany: Register with Finanzamt (Fragebogen) โ†’ get Steuernummer. Kleinunternehmer: no USt-IdNr. Standard VAT: get USt-IdNr from BZSt. France: Guichet Unique โ†’ SIREN + TVA intra if standard.

Can I invoice in USD/EUR as EU freelancer?

Yes. Invoice in any currency. Show conversion rate + date. VAT calculated on EUR equivalent (ECB rate of invoice date). VAT return filed in EUR.

What if client refuses to pay VAT?

B2B: VAT is legally due. If reverse charge, client self-accounts โ€” you invoice โ‚ฌ0 VAT. If domestic, VAT must be on invoice. Non-payment = late payment rights (interest + โ‚ฌ40).

Do I charge VAT to UK clients post-Brexit?

UK = non-EU. B2B services: reverse charge (client self-accounts UK VAT). B2C digital: UK OSS (separate from EU OSS). B2C goods: export (0% VAT) + UK import VAT.

Can I use simplified invoices (under โ‚ฌ250)?

Germany: ยง33 UStDV allows simplified invoice โ‰ค โ‚ฌ250 gross (less fields). But: cross-border B2B still needs full invoice for reverse charge. Use full template to be safe.

What if I lose a VIES screenshot?

Re-check VIES. If still valid, new screenshot works. If now invalid: you had valid check at invoice date โ€” that's your defense. Document re-check date.

How do I handle deposits/advance payments?

Invoice deposit with VAT (if standard VAT). Final invoice: total minus deposit. VAT on full amount. Kleinunternehmer: no VAT on either.

What about subcontractors I hire?

They invoice you (reverse charge if EU, domestic VAT if local). You reclaim input VAT (standard VAT only). Report in ZM if cross-border. Issue them correct invoice requirements.

Can I use Stripe/PayPal invoices for VAT compliance?

Only if they include ALL mandatory fields (your VAT ID, client VAT ID, reverse charge text, sequential numbering). Most don't. Use our Invoice Generator โ†’ send PDF + Stripe link.

What if I work via a personal holding company (GmbH/UG)?

Company = separate VAT entity. Thresholds apply to company. You = employee. Different rules. Consult Steuerberater.
